Analysis of legal issues concerning property rights arising from the "Interim Regulations on Real Estate Registration" and legislative suggestions

Real estate registration is an important system established by the Property Law. Its purpose is to safeguard the static order and dynamic security of real estate property rights. Although the current Property Law makes certain provisions on the effectiveness review methods and responsibility assumption of real estate registration, the provisions are not specific and detailed, affecting its implementation. In this context, on November 24, 2014, the State Council promulgated the "Interim Regulations on Real Estate Registration", which came into effect on January 1, 2015. The "Interim Regulations" make more detailed provisions on the efficiency procedures, review methods, and responsibility assumption of real estate registration, and are currently the main basis for real estate registration in China.

However, this stricter regulatory system has, to some extent, hindered the smooth flow of funds through existing financial channels. This may lead to businesses and individuals in urgent need of capital being unable to obtain necessary funds through the existing financial system, thus forcing them to seek alternative solutions and potentially resorting to illegal fundraising activities.

The legal aid team immediately adopted a "five-plus-two," "white-plus-black" work schedule. Lawyer Wu Yongneng provided ideas and solutions, intern lawyer Shen Lingjie was responsible for coordination and liaison with the China Welfare Lottery Fund project, intern lawyer Hu Xinsheng assisted in handling the entrustment procedures and collecting and verifying the information of the entrustors, and lawyer Peng Shijun was responsible for retrieving legal basis and supplements. After a week, the accumulation and organization of materials was finally completed. However, on December 28th, at the case acceptance office of the Gongshu District Labor and Personnel Dispute Arbitration Committee, after review and verification by clerk Zheng Yu, the case was not filed: there were several discrepancies in the migrant workers' ID information and signatures, which raised doubts.

I. Case Reason: Negligence of Duty Case of Lu ××× In the first instance, the defendant Lu ××× was found guilty of negligence of duty and sentenced to one year in prison with a one-year probation. The defendant appealed the verdict, and after a review by the second instance court, the original verdict was overturned, and the defendant was found not guilty.
