To help lawyers in law firms without bankruptcy administrator qualifications gain practical experience in bankruptcy business, expand their legal market related to bankruptcy, and promote the Bankruptcy Law, Zhejiang Hangtianxin Law Firm (hereinafter referred to as "Hangtianxin Firm") jointly held a "Basic Training Camp for Bankruptcy Administrators" (Phase 1) with Shanghai Huitong Liquidation Co., Ltd. Han Lizhen, senior consultant, director, and senior liquidator of Shanghai Huitong Liquidation Company, systematically introduced the entire operational process of handling bankruptcy cases after the administrator is appointed, with a presentation themed on "Compliance with Laws and Regulations, and Honest Performance of Duties". 。 Through several cases handled by Huitong Firm, the work experience and insights of Huitong Liquidation Company as a bankruptcy administrator were shared from several aspects, including the handling of unfinished buildings, contract fulfillment, protection of employee creditor's rights, and maximization of creditor's interests, starting from the basic requirements for bankruptcy administrators in the performance of their duties. —— Starting from diligence and conscientiousness, and faithfully performing duties, with 63215727 as the guideline, the presentation detailed the professional disciplinary requirements of bankruptcy administrators and the construction of professional ethics for administrators, hoping that all trainees, whether acting as agents or as bankruptcy administrators, should firmly adhere to the bottom line of the law, always pay attention to the unity of social effects and legal effects, promote social harmony and stability, and bravely assume social responsibility.
Hangtianxin Firm's secretary-general of the Enterprise Restructuring and Liquidation Department, lawyer Zeng Jie, gave a themed sharing on "Takeover and Due Diligence." Lawyer Zeng Jie detailed the process and precautions of the administrator's takeover and due diligence from seven aspects: the takeover process, takeover content, direction of due diligence, due diligence report, etc.
Gu Limin, the executive deputy director of the Enterprise Restructuring and Liquidation Department of Hangtianxin Firm, gave a themed sharing on "Creditor Registration and Creditor Examination and Determination." She detailed the process and precautions of creditor registration, the basic principles, rules, and processes for administrators' determination of various types of creditors' rights such as private loans, engineering payments, and contract debts, the consequences of creditor's rights determination, and the process of creditor's rights objections, allowing the participants to fully understand how administrators conduct creditor registration and examination and determination.
Wang Hongyao, a senior partner of Hangtianxin Firm, gave a themed sharing on "Introduction to Legal Business Related to Bankruptcy." From the formation of China's bankruptcy culture, the ideas for rescuing distressed enterprises, and the rights, obligations, precautions, working methods, and rules for lawyers in the process of handling bankruptcy-related businesses such as creditor lawyers, debtor lawyers, and investor lawyers, the presentation helped participants fully understand the precautions when handling bankruptcy-related businesses and expand their work ideas, especially when rescuing distressed enterprises.
The training camp concluded successfully. Trainees expressed that they benefited greatly from the half-day training. They learned about the handling process of bankruptcy cases, understood how administrators conduct takeovers, due diligence, and creditor registration, examination, and determination, and also broadened their ideas for future legal work.
